You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You may not use the Service to infringe upon the intellectual property rights of others.

You retain all rights to the content you create using the Service. By using the Service, you grant Phanes a non-exclusive, worldwide, royalty-free license to host, store, and process your content solely for the purpose of providing the Service to you. We do not claim ownership of your content.

The Service offers various subscription plans with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Payments are processed through Stripe, a third-party payment processor. By providing payment information, you authorize us to charge your payment method for all fees incurred. You are responsible for providing accurate payment information and updating it as needed.

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. We offer a 30-day money-back guarantee for annual plans. Monthly plans are non-refundable but can be canceled at any time.

We reserve the right to change our pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will provide at least 30 days' notice of any price changes.

Your subscription plan includes specific usage limits (e.g., number of ads per month, video duration). Exceeding these limits may result in additional charges or service restrictions. We reserve the right to enforce usage limits to ensure fair use of the Service.

You may not: (a) reverse engineer, decompile, or disassemble the Service; (b) use automated systems to access the Service without authorization; (c) attempt to gain unauthorized access to the Service or related systems; (d) interfere with or disrupt the Service; (e) use the Service to transmit viruses or malicious code; (f) resell or redistribute the Service without authorization.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users. Upon termination, your right to use the Service will immediately cease, and we may delete your account and content.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

To the maximum extent permitted by law, Phanes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify and hold harmless Phanes and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the German Arbitration Institute (DIS), except where prohibited by law. The arbitration shall take place in Berlin, Germany.
